TO WHAT EXTENT THE STUDENT IS PROTECTED NOWADAYS 

Some days ago the day of students was celebrated.  To what extent the student is protected nowadays or to what extent s/he is ready to work as a professional after graduating the university. The high educational institution is the place where the student is being developed and becoming ready to work in the field s/he has chosen. The Main Law of the RA grants an opportunity to everyone to get educated. The Main Law gives an opportunity to decide the principles of self-governance of the high educational institutions by law.

Every citizen has a right to get education in high educational state institutions free of charge based on competition.

ARE STATE AWARDS AND DECORATIONS INHERITABLE ?

- During the patriotic war my mother was a participant of Leningrad blockage. After the war she studied, later she held high posts and was awarded with state awards and decorations including numerous service medals and badges. Two years ago she died suddenly. I went to the Notary’s office so as to accept my inheritance. I provided information about the real property and produced the state awards, decorations and anniversary service medals and badges. The notary public informed me that I had no right to inherit all the state awards, medals and decorations, as well as the anniversary badges. Is that really so?

HOW TO PREPARE A STATEMENT OF CLAIM AND SUBMIT IT TO THE COURT

- I had a quarrel with my neighbor relating to the toilet built on the adjacent land. I applied to the district administration, municipality and cadastre. The latters advised me to go to the court. Now that I have applied to the court, it determined to reject my claim by giving reasons that the claim was not drawn up according to the court rules. I turned to my lawyer. He required a separate sum for the consideration of my case and another sum for drawing up a claim and another sum for defending my case in the court. I am a pensioner and insolvent. How long shall I still breathe the “smell” my neighbor’s toilet? In conclusion, I would like to mention that I am one of the regular readers of “Iravunk” (transl. “Law”) newspaper.

A DEVIL IN THE CITY

In the 70s in Yerevan under the instructions issued by the Chairman of Yerevan City Council Hasrutyan, it was planned to afforest and adorn the city with flowers. Millions of roses and trees were planted in various parts of the city. Every morning before going to work, the chairman of the city council used to walk on the streets and personally inspected the cleanness of the streets and observed the afforestation operations. One day one of the heads of the administrative district of the city reported that the territory was afforested in the evening but in the morning the roses disappeared. “Probably there is a devil in the city”, - the head of the district reported.

WHO BARES RESPONSIPLE FOR THE LOSS OF THE PROPERTY GIVEN TO THE STORAGE?

1. Does the organization bare responsibility in case of loss of the property given to the storage of it?

According to the 2^nd point of the Article 851 of Civil Code of RA The bailee of property given to a coat check, regardless of whether the storage is conducted for compensation or without compensation, has the duty to take, for ensuring the safekeeping of the property and return it in good conditions.

The rules of the present Article shall be applied also to the storage of outer cloths, headgear, and other similar property left without submission of them for storage by citizens in places established for these purposes in organizations and means of transport.

THE TREASURE TROVE

“I am a driver of excavator. Some months ago I used to work in one suburb. I used to de destroy old houses in place of which there should be constructed new buildings. One night I saw in my dream that I was sitting on a nice box. Then the box has been opened and a guest came out of that box and gave me the box. But I was afraid of the guest and did not take the box. One part of the wall has shined in the morning during the destroying of it. When I approached to the wall it was turned out that there was a ceramic pitcher in the wall. The tractor had broken the pitcher and some yellow metals had fallen down. Soon it was discovered that those were golden bars, money and jewelry. The mass was nearly 10 kilos. I had called my boss. And suddenly a sixty-year-old man appeared and declared that he is the owner of that land and ordered the people who were with him to gather all the golden things. They did and left.  My boss had promised me that I would have a share from that. After one week he had given me 1000$ and advised me to forget about the event. When I had demanded that I should get more he said that I would never get anything and showed the combination of three fingers”.

BUY A LOTTERY TICKET AT LEAST

‘I am 53 years old and have no family. I cannot even imagine how I would have managed to care about my family if I am not able to care even about me. I do not work. I get subsidy by state and my relatives help. Why should one get milliards while the other has not even money for bread? Where is the justice? Maybe the God is with powerful ones?

NOT EVEN CONSIDERS AS A DOG

Three months ago I discovered dripped and dirty animal in the yard of Opera House. I thought that it was a baby bear but it was chao-chao dog. I took it home and in the next day to the doctor. I got used to it and the animal got used to our family. Nearly one month ago when I was walking with my dog in the yard of Opera house a young man approached to us by calling my dog with a strange name. Of course, my dog did not react and not even considered him as a dog. The young man declared that it was his dog and showed the stigma on dog’s leg and demanded to return the dog. When I refused to return the dog he began to insult me by calling “robber”. He called policemen who took our addresses and advised to solve the problem in the court. Is this young man right even if it will turn out that he was the owner of the dog? I am ready to give him money but not the dog.

THE MOTION OF THE GENERAL PROSECUTOR WAS LEGITIMATE AND THE DECISION OF THE NATIONAL ASSEMBLY WAS LAWFUL

Some days ago the National Assembly approved the decision to strip Former Minister of Foreign Affairs and present Deputy Vardan Oskanyan of immunity and to involve in criminal case as an accused.

A question arises: whether the motion of the General Prosecutor and the approach of the National Assembly were reasoned to fire their Deputy.

When the Queen of the United Kingdom is called to responsibility for exceeding the speed of her car the citizens of that country are not either surprised or get angry or discuss the fact.

When the Prince of the United Kingdom serves in the Army of the hottest places of the world- in Afghanistan, the citizens of that country consider that each citizen who loves the United Kingdom and especially the Prince is obliged to serve as an example.

ARMENIAN CHRONICS

I think that this Article concerns to all- to farmhand, to commercial, to student, to teacher, to judge, to head, etc.

I have an expression that the citizens of Armenia speak about justice more than anybody in the world. All speak- pupils, students, elders or younger. Everybody wants to live well but many people are ready to get to that level as a result of putting others in bad conditions.

Everybody wants to be appreciated and respected but do we evaluate people like us? Do we care about the problems of others the key to which we own? But in the morning we begin to speak about widespread injustice and we consider the power as the only medicine to solve the situation. Unfortunately, here starts the beginning of the End in the society in which written and not written laws act instead of the rule of law.

UNJUST ENRICHMENT

I am a head of state non-commercial organization. While assuming the director’s position I have discovered that some commercial organization unlawfully, without any leasing right occupied nearly 100 metr squares in the building which belongs to our organization and refuses to leave it.

Is it possible to demand not only to evict the area but also to compensate for the use of the area and the communal expenses for those years?

The Chapter 61 of the Civil Code of RA concerns the obligations arising as the result of unjust enrichment.

THE ELECTIONS OF THE MUNICIPAL SELF-GOVERNMENR BODIES

There are many calls concerning the quashing of the results of the elections of municipal self-government bodies (mainly the governor of the community).

After the elections  the regional electoral commissions make one of the following decisions:

1. about considering the governor of the community elected;
2. about holding re-elections in separate electoral constituencies;
3. about considering the elections of the governor of the community invalid;
4. about considering the elections of the governor of the community failed.

The governor of the community is considered the candidate who has received the highest number of votes of those who are eligible to vote.

WHEN THE PEOPLE ARE TAUGHT TO HATE THOSE WHO ARE LIKE THEM, IT IS A DISASTER

During the Soviet years when somebody’s rights were violated, it was used to write to the “Lenin's mausoleum” and it was believed that in this way the issues would have been solved. The bright example of that could be the letter of my mother (my mother worked as a cleaner at 1^st Hospital) immediately after which we got a flat in Norq.  Now I am writing to “Iravubk” newspaper nut I do not believe that there is justice in this country as the law and the rights are to be insisted here.

I got married in 1990, have 3 children and live in the house of my father-in-law. After the death of my father-in-law the house was divided between my husband and his brother. In 2005 my husband has left to work abroad and has not come back. Some years ago he used to call in New Years days but now he stopped doing so; maybe he has died somewhere. Now the brother of my husband has decided that me and my children should live in the street and brought an action to the court in order to evict us from the house.

THE HOMELESS WHO HAS DEPRIVED THE SOLDER OF HIS LIFE AT NOGHT SHOULD BE PUNISHED

Respectful “Iravunk” I am shocked by the fact of extradition of the Azerbaijani officer which has deprived Armenian officer Gurgen Margaryan’s life with an axe secretly at night,  by the Hungary which is considered European country; and the fact that  the President of Azerbaijan has pardoned him. If these are the European values then I spit on such. We should have not believed to the justice which turned to be false and we should conduct our self-judgment.

What do our attorneys think about bringing an action concerning such disgraceful contract?

BLOODY INHERITANCE

We still remember the bad case happened in our family during the bad 90s. My brother flowed the oil from the kerosene stove on my mother and wanted to burn her but then he changed his mind. My mother did not apply anywhere and that event was kept only among our relatives.

My mother died a week ago. It is turned out that my mother had made a will according to which she left all her property to my brother. I do not want that there is such impression as I have aye on my brother’s property but I also do not want that the one who tried to kill my brother inherit all the property. I just want the party of inheritance to which I have rights. I have right to inheritance, don’t I?

THE LOVE CAN CONCERN ALSO MUCK

My son is 28 years old. He is a doctor. One year ago he felt in love with a girl who was 5 years younger of him. He felt in love so that he got uninterested in his parents, sister, relatives and his friends. When I saw that girl for the first time I remembered the ancient adage: the love can concern also muck. When i expressed by negative opinion about her, my son was offended. In one word, I did not recognize my son.

One month ago my son declared that he had been cheated all this time and that now he realizes that so called girlfriend kept friendship only for certain interest and now she has another boyfriend. Moreover, my son has presented our bungalow which his grandfather had presented him in his 25 anniversary to that girl in secret from us. When we tried to speak to that girl she declared that we were threatening her and she will apply to the police. We applied to the police and it turned out that the girl was not guilty. I cannot imagine how can Armenian girl play with the feelings and become an owner of bungalow. I wish my son’s example would serve as an lesson for other younger. Please, tell me what should I do?

TIME-FREIGHT

It is usual that foreigners need such transport means that the management, protection, technical exploitation services should bare the service provider company and the harm caused to third persons should bare the transport providers.

The following legal norm concerns such cases which is called timely freight.

Actually this ancient contract is considered to be such one which has been used and is being used in all corners of the world even in Antarctica. It is used during discovery of continents, during scrutinizing the residential places, during realization of different works, during traveling etc. The nature of this contract is that the contract for rent of transport mean with its staff is concluded as a result of which after paying certain amount of money the transportation is passed to the temporary use of lessee. The lessor shall have the duty, during the whole time period of the contract of lease of means of transport with crew, to support a suitable condition of the means of transport given by lease including conduct of current and major repair and provision of the necessary accessories.During the conclusion of the contract the parties are free to choose any service stipulated or not prohibited by law.

I HAVE NEVER ASKED MONEY AS A BEGGAR

I was born in 1995. My mother died at birth. One month late my father died as a result of car incident. I was under care of my grandmother. I almost have not gone to school but I can read and now I take English lessons. My first work experience was at the age of eight. My grandmother gave me matches and I was selling it near GUM called market. At the end of the day when I gave the money to my grandma it turned out that I earned enough money which was enough to live with the salary of my grandma. I have never asked money as a beggar in honor to my grandma. Since the age of ten I was a carrier in the market. Then I became a pupil of car repairer. It is almost one year that I have been working myself. One month ago the regional policeman told me that I should register my business in tax service. I went to tax service where I was told that I am still minor and I should wait until becoming mutual. My 18 will be 1year and 3 months later. Please, intervene in order I will be able to work and earn money. I will go to serve in the army after half and the year.

PROSTITUTION OR THE SOLVERS OF SURVIVAL WHO ARE WITHOUT WORK

I am a taxi driver. Have trip in Yerevan at night and you will see who are the owners of the city at night. They are prostitutes and the sutinyors especially from the regions. You will have the expression that we all are prostitutes and sutinyors. Where is our honor? Where does the power look? I will not speak about the Police because there is possibility that I will be guilty for something suddenly. We like to guilt the communists that they were atheists and Satan. It is better to have atheist and moral country than the country unmoral but with the God. My heart is harmed and I am sorry. Instead of showing serials for hours and instead of preaching unhappy happiness and broken love, show how do the entries of the buildings of the city smell in the absence of WCs and how the prostitutes own the city at night.

I WILL BRING AN AX AND CUT THE TREE

My father bought a part of house in Shengavit administrative region with internal sales contract years ago. The parties had agreed that the entry to the house would be from the land of neighbor. My father died in 2000 and the son of the previous owner decided that he did not allow us to have entry from their own land anymore. As in the famous fable, my neighbor threaten us that he would bring an ax and cut the tree down every time when there is something wrong and announces that the land is his and he does not allow us to cross it.

THE WIN IS FOR THE VOTER

RA organized unprecedented elections in its new history. I think that there were no such elections during the governance of first and second presidents, so it should be articulated: The practice of creating a power with just elections was established during the governance of third president. Those were elections which results merely would influence the results of elections. In the elections of today their great investment have done not only the acting president but also some active political parties in the political arena, maybe most of them were from opposition. Conclusion is the only one: we have had free and just elections in a result of which the winner is the voter and it does not matter for whom he/she has given his/her vote.

THE TOURIST, THE GARBAGE AND THE LOSE OF MONEY

Dear readers, I have traveled all over the world and there is no place that I have not been. I and my friend after 40 years absence came to Armenia where I was born but since the early childhood I was transferred to Canada. The natural marvels that I saw here I have not seen anywhere else. I think that the God have created the nature of Armenia with great love. It has become common for you as you get up and see this wonderful nature every day.

THE TERM “SECTION” ITSELF DOES NOT MEAN INSULT ITSELF

As it is known, the organization “Kyanqi Khosq” sued 3 famous medias for harming dignity and business reputation and for publishing religious hate creating information and demanded to force to excuse publicly. Since the first judicial session there are many calls from our citizens who want support somehow. Some of them are warried about the event happening, some want to be informed t whether the 3 medias have strict legal grounds.

The fact that the reader of the media wants to support the media in such circumstances means that this media is on the right way and in the party of the reader it has great protector. What concerns the civil claim I think that it has no future as it has no legal grounds.

TAKE PROPER MEASURES IN ORDER NOT TO GET THE COURT

My son is 11 years old. He had a pain in foot and stomach. Two weeks ago my mother and my wife took him to the center of our region to be checked out. My wife called to me from the hospital and said that I should send her money as my son had to stay in hospital for some days. I have sent. Five days later they told me that everything is normal but my sun made out of order the check up device and I had to pay 150,000 AMD. I went to hospital and told them that I thought that a little child could not spoil the device and asked  to decrease the sum of money in order to pay the money in some months. They even did not listen to me. I applied to the head of our village in order to intervene and tell the hospital that I could not manage it. I have 4 children and old parents, please help me not to get to the court.

DESTROYED FAMILY

This story is about a destroyed family.  This family was mentioned as a successful family example ever by public but on the eyes of the same public it collapsed and became a destroyed family. I wish it does not seem that I try to sorry this family in your eyes. It is a story of my life which I don’t wish to happen to anybody.

I was born in Petersbourg city. My mother and father were famous architectures. They were invited to Armenia in 1970s by the State. I went school in Yerevan, then I entered  musical school and after I graduated from Conservatory. During a party I got acquainted with a wonderful young man who was studying in present Economic University of Yerevan then I got married to him. We had twin boys.

SUICIDE OR VOLUNTARY CHOICE OF DEATH

Dear reader, the number of suicides has grown. There are many organizations and individuals that directly or indirectly induce the person to conduct a suicide. This article aims to prevent the reader from such extremely rough mean and also to interpret the suicide, the reasons of that, the legal consequences of incitement to suicide and incitement to committing suicide and also to compare it to the self-sacrifition.

It seems that the development of science and technics will proportionally decrease the social conditions of society.  But it is still difficult to say that the concerns of ancient people were fewer and they were happier than those of modern people. For me there is the following formula: how a person goes far from the spiritual things than he takes an abuse on him which he is not able to carry and as a result of that he is capable to conduct any extreme including committing suicide.

In my opinion, the most recognized suicide in the world is the suicide committed by Judas. As according to Gospel suicide is one of the most awful sins, each of us should come to the following conclusion: suicide, being voluntary choice of death, is against the God and his laws. I think it is the main reason that the ones who committed suicide are not guaranteed the right to requiem, right to burial and other spiritual events.

THE PROBLEM OF STATE IS TO GUARANTEE ITS CITIZEN’S RIGHTS

It is going to be held elections of legislative body this spring. There are discussions going on whether 100 percent proportional or majoritarian. But nobody wants to confess that no fair elections were held in Armenia ever. The means of electoral falsifications and the tactics are only changed.

If during the elections held during the governance of first president bunch of ballots were thrown into the box from pockets or other places of body, during the governance of second president there was a “Karusel” (“Swing”) mechanism according to which the resident of one community could easily go to another and vote there. During the governance of third president there have not been held any elections yet (except some elections of municipal organs), so we cannot held that it would be similar to previous ones and would be called “one step forward”.

TAKE CARE OF YOUR CORPSE

I had a small business in one of the communities some years ago when in Yerevan city there were communities. One morning one of the workers informed me that somebody broke the window and stole the assets of the company. By that time I was at doctor’s. I asked the worker to call to the Police. I was able to get to the place of crime only at afternoon. The policeman of the community told me that he suspends that I am guilty in created crime because even knowing what had happened I got there only 4 hours later. Then he asked the worker to refuse the announcement about the crime and promised to discover the crime.

THE DECISION OF THE COURT STAYED ON THE PAPER

Some years ago I lend money to my neighbor without interest who then became alky and non-payable. I had to apply to the court. The judicial procedure lasted one year after which the worker of the Judicial acts’ enforcement service advised me to sell by the court the house of my neighbor which belonged to his son also. This procedure lasted approximately 3 years. Now the Judicial acts’ enforcement service tells that the house cannot be sold as they are not able to find the son of my neighbor in order to give his consent to sell the house by bargaining. So, the decision of the court stayed on the paper. If the State does not respect its citizen it should respect the statement “HANUN Republic of Armenia” based on which the decision was made. What can you advise me? Please, help me.

JURIDICAL ACTS AND THEIR APPLICATIONS IN PRACTICE

Justice in Armenia is administered by courts. The acting three-degree court system and the legislation field stimulate so that a definite part of civil and administrative cases “travel” in various courts for years on along with their owners and representatives, whereas after the juridical act becomes effective… (it will be interpreted a bit later).

WHAT PERIODS ARE ENVISAGED FOR THE SUBMISSION OF A CLAIM WITH THE ADMINISTRATIVE COURT

I have my own trade stand (booth) where I am engaged in retail trade. In 2010 Tax Authority conducted inspections of accuracy as to the performance of separate requirements of the Legislation controlled by the Tax Authority and accuracy as to the interrelation with the budget. As a result, an act was drawn up to the amount of a few million of drams. At the end of the act there was a statement written in black that the given act could be appealed with tax authority or the court within six months’ time. Disagreeing to the act three months later I applied to the administrative court which rejected my statement of claim by giving reasons that the time for the submission of the claim envisaged by the court expired and that I did not have any solicitation regarding the missed period excusable. Please clarify the matter if I was treated correctly or not.

LABOUR CONTRACT IS AN EXCEPTION FOR A DEFINITE TIME

I took part in a competition which envisaged that after winning I was to work on permanent basis. I passed the competitive stage, but I signed a one-year contract. After the expiry of the contract period, I was discharged based on the grounds mentioned above. I wonder if the employer was right or wrong in doing so?

A REPRESENTATIVE IS OBLIGED TO ACT IN THE INTERESTS OF THE ONE HE REPRESENTS

In civil and legal relations each person himself/herself determines to enter into the given relations and each person himself/herself determines when this or that action is to be implemented. In other words, the Bible says that God awarded free will to people which is undoubtedly true. It is another matter how this free will is to be manifested in daily life. How is it that people created free and equal become unfair in life along with all the legal consequences arising out of it?

OUR COUNTRY REQUIRES EDUCATED GENERATION

During all my conscious life, I dedicated myself to teaching. I worked at school, later in people’s educational department of executive committee. With a heavy heart I have to declare that the concentrated program that was developed and used during USSR years in kindergartens, schools, institutes is not  applied today. Now it bears a name “market relations” and the sphere of education was converted into business and market. Today education is not free, whereas the right for education is not enjoyed by everybody. Yet, the country requires educated generation. Why does the state not regulate the sphere of education for everybody to enjoy it freely? Should you enter any kindergarten, school, institute you will witness the corrupted system existing in the mentioned spheres.

HOW TO ADOPT A CHILD

A couple of days ago, a man called up our office, identified himself as RA citizen and informed that he had been on intimate relationship with his friend for around three years who was also a male. They loved each other and wished to adopt a son. He wished to know if it is envisaged by an intergovernmental law or not and if it is prohibited, then which provision of the law is restricted by the Legislation as he says “The right to adopt a child for us, spouses”.

THE GROUNDS FOR THE POWER OF THE COUNTRY LIES IN A STABLE FAMILY

In 2003 I got married. After the marriage we lived in the house of my husband’s house. In 2004 my daughter Ani was born. After the birth of my child I thought my husband would be strongly attached to the family. but…. In 2006 we got divorced and I moved to live in the house of my parents. At first my husband used to call me and enquire about the child as if he was missing her, then he stopped calling me. Recently I decided to leave the republic temporarily with my child. The passport department said that the written consent of the child’s father was required. I tried to find my husband and I found out that it was already three years that he had been absent from the republic and his whereabouts were unknown. Dear, editorial staff. My father used to live in one of the remote regions of the Republic of Armenia. Three months ago, my father moved to live with me in the capital on account of his poor health. He stayed in hospital two months, afterwards, he was discharged from the hospital. I took care of him for about one month. Ten days ago my father died. I applied to the death bureau as to the residential area so as to obtain a registration certificate. They responded to me that I ought to apply to area bureau in charge of the place death occurred. I AM DISAPPOINTED WITH JUDICIAL INJUSTICE

I am disappointed with the unfairness of juridical system. In 2005 I lent 5000 dollars to the son of my neighbour for the period of one year. After the expiry of the agreed period, he failed to give my money back based on different motivations. I had to apply to the court. The court required 100 dollars as judicial duties. Afterwards, the court examined my case and in the end it was rejected by giving reasons that my debt was overdue.

My generation which is a generation of 30s of the previous century, saw Stalin, Beria, wars and hunger. Our Armenians and senior friends took part in a patriotic war and many of them never returned. Thirty-one people were recruited from our street (a small area of now Alaverdyan street), twenty-two of which never returned and the rest became disabled. I clearly remember how our mothers and grandmothers used to knit woolen gloves and socks for their offsprings and husbands and sent them to the front. The entire country rebelled against its enemy and that is the reason why it won the war. Many years passed, the united country collapsed and Armenia became independent. The victory of our hero Armenians remained in our hearts.

SECRET OF HAPPINESS

I am Ani Sargsyan, aged 35. I married my beloved person. During my marriage life, I had two children. MAYOR’S “NAZIR-VIZIRS” (SUBORDINATES) ORDERED TO REMOVE A FORTY-YEAR EXISTING GARAGE

I am a native Yerevan citizen. My father and my grandpa were born in Yerevan. A metallic garage under the name of my father has been located in the yard of our building since 1970s regarding which I have a special license. Recently municipal authorities have sent a written notification stating that the garage hinders the improvement operations in the yard and as a movable property it shall be moved away. A legal garage located motionless for forty years is all out of the blue moon viewed by Yerevan Mayor as a movable property, and his “nazir-vizirs” (subordinates) order me to move it away. Thus, is my property movable or immovable?

Dear, “Iravunk” newspaper, I wish to express my gratitude to you and all the mass media which highlighted the competition events of football combined team. These days the entire Armenians shout for their favourite team. Each of them deserves praises. I wish to express my special thanks to the senior referee of the team Vardan Minasyan. Due to his immediate efforts we have this team which brings us honor. But the events that happened during Ireland-Armenia game, the unjust arbitration which was done by a senior referee of the game, will remain on his conscience. I wish to clarify if the arbitration error which was done during the game which was of essential significance and affected the game process, as well as the serious consequences it caused, is a penal action.

MY WIFE SPENDS TOO MUCH

I am 32 years old and a programmer by profession. A year ago I got married but it was not a fortunate one. Firstly, during the marriage ceremony the main expenses of the wedding were borne by me. After the wedding, during the wedding trip I spent 900 dollars of my saved money. Afterwards, I purchased a two-room apartment by credit. The entire expenses regarding the house were borne by me. Recently, she declared that we were going to have a baby. I had very tense days and I wish to get divorced. Please, tell me if I will be able to recover all my expenses spent on my wife in case of divorce.

I am a lonely pensioner. I receive an old-age pension which totals 31.000 drams which is hardly sufficient for my medicine and utilities. I am living alone. My neighbor above suggests granting me 100.000 drams per month, that after my death she will bear the expenses of my funeral and the apartment will be transferred to her possession. I have a good opinion of her, but I would like to have a document certifying that I will not be out in the street in my old ages. Please, help me.

ONE SHOULD NOT DO SOMEBODY A FAVOR

On November 23, 2009 my sister-in-law persuaded my husband to be a guarantor for her business. Afterwards, my sister-in-law received a loan from the bank to the sum of 130.000 dollars, whereas the house and the ground land owned by me on basis of an ownership right was pledged with the bank. Meanwhile, my sister-in-law established her own company in Dzoraglukh village, Aragatsotn region and then notified the bank that she was in no condition to redeem the credit liabilities assumed. Afterwards, the bank sent me a notification of exaction which stipulates that in the near future my own house and the ground land will be transferred to a third person for further direct sale thereof. It is true that one should not do somebody a favor. I will have to hand over my house and the ground land created during all my life to another person on account of my sister-in-law.

HOW CAN I SUE MY KIDS?

Recently an eighty-year-old woman came to the office of our company who complained that her pension was not enough to pay for the public utilities and she did not receive any help from her children (she has three sons and one daughter) since every child agreed to help their mother in case she donates her own house in full to them by an ownership right, but the old woman wishes that after her death each of her children received her flat in equal parts. As a result, she faced in an absolutely difficult situation and she is seeking advice as to her future actions.

A WORKER IS NEITHER A SERF NOR SLAVE

The former USSR superpowerful country, an integral part thereof today, is the Republic of Armenia along with its serious series of mischiefs and faults (I think the biggest mischief is the atheism doctrine and worshipping terrestrial idols) which had an institute of accomplished labour law which was the only of its kind in the whole world. Laborers and workers enjoyed so many rights in the mentioned superpower country, the core of which was laborer-peasant alliance. Today the workers of the most developed and democratic countries can hardly dream of the mentioned rights (for example granting apartments to young specialists, post-natal privileges, medical clinics, free rest houses). After the collapse of the union, labour class conception in Armenia as such went down in history, but it gave a new rise to the relations between an employee and employer. These relations very often end up in disputes which are mainly settled in court instances.
